Legal vs. Physical Custody

Parents may obtain two types of custody in Michigan. Both must be established by mutual agreement or by the courts.

Legal custody: This grants you the right to make decisions that have a major impact on your child's life. These can involve his or her religious upbringing, education, medical treatment and finances. It is rare for parents to disagree over the award of legal custody.

Physical custody: This determines where your child will spend the most time (his or her primary residence). It is common for parents to disagree over physical custody. It is important to note, however, that no matter where your child resides, you can still maintain a caring, consistent relationship with him or her through the creation of parenting time schedules.

Joint vs. Sole Custody

Most custody arrangements are shared. That is, each party has joint legal and joint physical custody of his or her child. If parties cannot agree on this matter, the court may be forced to award sole physical custody to one parent.

Joint legal custody: Not all cases are well suited for this type of arrangement, particularly when parents cannot agree on major life decisions regarding their child. Typically, however, the court will consider joint legal custody to be in the child's best interest.

Joint physical custody: Joint physical custody does not necessarily mean a child will spend equal time with each parent. As a result, spouses who maintain this type of custody must still hammer out a workable parenting time schedule.

Sole custody: Contrary to popular belief, sole custody is hard to obtain. Michigan courts operate under the presumption that joint custody is in the best interest of your child. Parents seeking sole custody must present a compelling reason for doing so.
